What is Bail?

Bail is the temporary release of an accused from custody pending trial and is granted with or without sureties, as per the provisions of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.

Types of Offenses and Bail in India

Article 21 of the Indian Constitution guarantees the right to life and personal liberty, ensuring that detention is only permissible under lawful circumstances. The BNSS, 2023, upholds these rights by defining bail provisions, with imprisonment as an exception.

Offences and Bail:-

Offences are categorized as bailable or non-bailable under BNSS:

  • Bailable Offences: Less severe crimes where bail is a right and must be granted without court discretion.
  • Non-Bailable Offences: Serious crimes where bail is subject to judicial discretion. Courts evaluate the nature of the crime, the accused’s conduct, and potential threats to victims or witnesses before granting bail.

Types of Bail

1. Regular Bail: Provided to those already arrested and in custody, governed under BNSS.

2. Interim Bail: Temporary relief granted while awaiting a decision on regular or anticipatory bail.

3. Anticipatory Bail: Protection granted to individuals fearing arrest, ensuring they can avoid custody before an FIR is filed or during the investigation phase.

High Court’s Authority in Granting Bail:- 

For serious offences such as murder, the High Court can be approached if bail is denied by a lower court. Under BNSS, 2023, the High Court and Sessions Court have discretionary powers to grant bail for crimes punishable by seven years or more.

The High Court may impose conditions, revoke bail, or order arrest if necessary. It also considers factors such as the accused’s health, age, and gender while ensuring justice and fairness.

High Court’s Authority on Bail under NDPS and UAPA Acts:- 

Under the NDPS Act, stringent bail conditions are imposed under its special provisions, overriding general bail provisions in BNSS. Courts ensure strict scrutiny before granting bail in such cases.

Similarly, the UAPA Act restricts bail under specific conditions, with courts considering the gravity of charges. High Courts exercise jurisdiction based on established legal principles and case precedents.
